Professional negligence and the law

If somebody who works within a certain profession performs a part of their job short of the legal standard and care then it can potentially have detrimental consequences for you. Professional negligence can therefore be defined as a “subset of the general rules on negligence to cover the situation in which the defendant has represented him or herself as having more than average skills and abilities”. Taking this into account, professional negligence is essentially about compensating those who have fallen  victim to a business professional’s mistakes which have essentially lead to damages or financial loss.

In order for you to successfully make a claim, it is essential to understand the procedure as certain rules and regulations must be followed in order for a claim to be substantiated.

What is the procedure?  

The minimum requirement when someone submits a professional negligence claim is to adhere to the pre-action protocol. Firstly, the claim must be outlined in a Letter of Claim whereby the defendant has 21 days in which to respond. There will be attempts to see if the dispute can be settled outside of court. If it cannot and it is decided that the matter must proceed, then a Claim Form can be submitted and both parties will be expected to set out their respective cases in writing with any supporting documents and witness statements as evidence. Mediation can be considered at any stage during the proceedings and for claims of up to £150,000 the Financial Ombudsman Service may be available to offer an independent assessment of a claim and award compensation rather than involving the courts.    

Remember, in order for there to be a legitimate claim there must be a binding contract between the two parties whereby the professional provides a service that would be considered unacceptable by another competent professional.  If this sub-standard service leads to damages or financial loss for you, then a claim can legally be made.

If the claim that you have made is successful then you will receive compensation from the defendant which can vary depending on the circumstances surrounding the case.  If the claim is heard in court, the idea is to reimburse you of any money lost during your interaction with the respective professional.
