Independent Adjudications

Offences against prison discipline are dealt with by the adjudications system. If an offence is deemed serious enough to warrant the imposition of additional days then the governor will refer the case to the Independent Adjudicator. This is a District Judge who attends at the prison for the hearing.

Following a European court ruling anyone who faces such hearing is entitled to legal representation. This means an advocate can attend and represent you just like at court. This representation is FREE as it is available under legal aid. Should someone be found guilty at a hearing it is almost inevitable that the Adjudicator will impose additional days. This could be the equivalent of an extra 6 weeks to serve in custody and as such it is extremely important to have representation. People wouldn’t attend a magistrates court without a solicitor and they shouldn’t attend an adjudication without one either.
