What is Adoption?

Adoption is a way of providing new families for children who cannot be brought up by their biological parents. For example, because it is no longer safe for the child to continue living with his or her parents and the court has deemed that it is in the child’s best interest to be adopted. An Adoption Order is arguably the most serious Order the Family Court can make.

To be adopted, a child must be:

  • Under the age of 18 when the adoption application is made
  • Not be (or have been) married or in a civil partnership

What is the effect of Adoption?

The effect of an Adoption Order is that all Parental Responsibility is transferred to the adopters. In doing so, it effectively extinguishes the Parental Responsibility of the birth parents and anyone else who may have acquired Parental Responsibility for the child.

The adopted child will become a full member of the adopted family and will quite often take the family’s name. The child will also have the same legal rights as if they were the birth child of the adopter for example, rights of inheritance.

What is the Procedure?

Both birth parents normally have to agree or consent to the adoption, unless:

  • They cannot be found.
  • They are incapable of giving consent.
  • The child would be at risk if they were not adopted

You may be able to adopt if you are 21 years of age or over and either:

  • Single
  • Married
  • In a civil partnership
  • An unmarried couple (same sex and opposite sex)
  • The partner of the child’s parent
