What is Blue Badge Fraud?
There are two types of Blue Badge Fraud:
Misuse use of a disabled person’s badge
Misuse of Blue Badges is highlighted in the Road Traffic Regulation Act 1984 section 117. The misuse of a blue badge covers any person who uses a blue badge that they are not the named holder of and any person who uses the badge to park in a pay and display or disabled zone without the badge holder being present.
Fraudulent abuse of a blue badge
The fraudulent abuse of a blue badge is highlighted in the Fraud Act 2006 section 1. Abuse of a blue badge relates to any person that uses a badge that has expired, has been lost by the rightful badge holder, is not genuine or has been altered for someone else’s purpose.
What are the consequences?
You might be prosecuted in the criminal courts, receive a conviction for an offence of fraud and a criminal record.
If you are caught parking in a disabled bay with a blue badge and you are not the holder you could be issued with a Penalty Charge Notice and your badge might be confiscated.
