Blue Badge Fraud | Misuse Of Blue Badge | Penalty | Prosecution
Blue Badge Fraud and misuse are serious offences contrary to the The Fraud Act 2006 and the Road Traffic Regulations Act 1984. Blue Badges entitle the badge holder to free parking in pay and display areas and allows the holder to park in disabled zones. If you use a badge to park without the holder being present, or use a lost or stolen badge, you may be prosecuted in the criminal courts. If you have been invited to an interview under caution, or are being investigated or prosecuted for alleged blue badge fraud or misuse, it is in your best interest to seek legal advice at the earliest opportunity. At Cartwright King, we are here to defend you from start to finish and protect your best interests.

What is Blue Badge Fraud?
There are two types of Blue Badge Fraud:
Misuse use of a disabled person’s badge
Misuse of Blue Badges is highlighted in the Road Traffic Regulation Act 1984 section 117. The misuse of a blue badge covers any person who uses a blue badge that they are not the named holder of and any person who uses the badge to park in a pay and display or disabled zone without the badge holder being present.
Fraudulent abuse of a blue badge
The fraudulent abuse of a blue badge is highlighted in the Fraud Act 2006 section 1. Abuse of a blue badge relates to any person that uses a badge that has expired, has been lost by the rightful badge holder, is not genuine or has been altered for someone else’s purpose.
What are the consequences?
You might be prosecuted in the criminal courts, receive a conviction for an offence of fraud and a criminal record.
If you are caught parking in a disabled bay with a blue badge and you are not the holder you could be issued with a Penalty Charge Notice and your badge might be confiscated.
This may affect your career and personal circumstances so it is important to seek early legal advice.
