Drug smuggling and the law
Drug trafficking can be defined as the controlled illegal movement of drugs from one country to another without paying any form of tax. It is often a crime that requires a great deal of planning and time as it involved the cultivation, production, distribution and sale of drugs – often across several geographical locations.
According to the Misuse of Drugs Act 1971, illegal drugs can be categorised into three groups of A, B and C with A being the most serious. The details of these groups and the drugs associated with them are shown below:
Class A drugs – The most notable class A drugs include cocaine, heroin, ecstasy and morphine.
Class B drugs – The most notable class B drugs include cannabis, amphetamines (speed) and ketamine.
Class C drugs – The most notable class C drugs include steroids and tranquilisers.
If you secretly import or export drugs such as those mentioned above into another country, then this is drug trafficking and you are committing a serious crime. The seriousness is such that if you are charged with this offence, the sentencing will be passed by the Crown Court who may be assisted by investigatory bodies such as HM Revenue and Customs (HMRC) and the Serious Organised Crime Agency (SOCA).
What sentence could you face?
|Class||Maximum Sentence||Sentence Range|
|A||Life imprisonment||3 years 6 months’ – 16 years’ custody|
|B||14 years’ custody and/or unlimited fine||12 weeks’ – 10 years’ custody|
|C||14 years’ custody and/or unlimited fine||8 years’ custody|
