Refugee Status, Humanitarian Protection & Discretionary Leave

Should your asylum claim be successful, you will be granted either: Refugee Status, Humanitarian Protection or Discretionary Leave to remain in the UK.

Refugee Status is issued for a period of 5 years and gives the entitlement to work and study.

Humanitarian Protection is offered on the basis that the applicant is at risk of serious harm in the form of the death penalty, execution, unlawful killing, torture or indiscriminate violence if returned to their country of origin.

Discretionary Leave is given at the States discretion and can vary depending on the age of the applicant, the circumstances of their case and the situation in their country of origin.
