The High Court Case Overview
The proceedings concerned two young children, aged three and nine, who were subject to allegations that their mother had fabricated and exaggerated medical conditions. As a result, professionals struggled to determine the one child’s true medical needs. The case presented several challenges, including disputed medical evidence, changes in the mother’s legal position, and the requirement of expert psychological and paediatric assessments.
Understanding Fabricated or Induced Illness (FII)
Fabricated or Induced Illness (FII) is a rare but serious form of child abuse where a parent or carer deliberately exaggerates, fabricates, or induces medical symptoms in a child. This can lead to unnecessary medical tests, treatments, and even surgical interventions. The parent or carer may not necessarily intend to deceive the doctors. However, their behaviour is likely to result in in avoidable physical and emotional harm to the child.
FII can be difficult to detect as it often involves a persistent and misleading narrative from the caregiver. This can make it hard for medical professionals to assess the child’s true health condition. FII cases require careful expert legal and medical investigation to protect children while ensuring a fair legal process for all parties involved.
Our Role in the Matter
Fiona Bowen, played a critical role throughout proceedings, acting on behalf of the children through their Guardian. She ensured that the children’s best interests were always at the heart of the proceedings. Her responsibilities included but were not limited to:
- Overseeing and organising extensive case documentation developed over the course of the year-long proceedings.
- Coordinating with the children’s Guardian and counsel to ensure a comprehensive legal strategy.
- Leading joint instructions for assessments, including a consultant paediatrician’s review of the child’s medical history and a psychological assessment of the mother’s mental health and parenting capacity.
- Managing the complex digital evidence process, which involved reviewing data from the mother’s electronic devices and medical records for forensic analysis.
- Providing legal expertise and support throughout multiple hearings, including securing the necessary expert input to assess the long-term welfare needs of the children.
The High Court Outcome
Following extensive legal argument and evidence review, the High Court concluded that a Care Order was in the best interests of the eldest child, ensuring she continues her placement in a specialist residential setting. The younger child was placed with her father under a Supervision Order and Child Arrangements Order, with carefully managed family time arrangements with the mother.
The judgment highlights the dangers of Fabricated or Induced Illness (FII) and the need for safeguarding professionals to work together and share information freely to protect children. The case also highlights the significance of legal intervention in protecting children from potential harm while ensuring parental rights are fairly considered throughout the legal process.
