Are students entitled to compensation after a University strike?

One of our Education Solicitors, Deborah Robinson, has been featured in an article on the GRANTfinder 4 Education website.

The article addresses the growing call for students demanding compensation owing to the University and College Union (UCU) strikes that have impacted student education by the cancellation of lectures.

In the article, Deborah agrees that whilst students may have sympathy for striking academics, they will also be concerned about the impact the strikes have on their education.

Deborah also discusses whether universities ought to consider whether the loss of teaching will have an impact on students’ ability to perform in assessments.

Some student led initiatives, including the ‘Students against Strikes’ campaign created by students at Kings College London have been put in place to fight for student rights during the academic strikes by the UCU.

With strikes being set to continue and little solution for fee paying students’ plight on the matter, this remains a large problem.

Deborah comments:

"Whether or not students are legally entitled to compensation will require an analysis of the terms and conditions they agreed to when enrolling on their course, or any terms which can be said to be implied in that agreement.

"Some students may feel compelled to appeal any future grades awarded if they are concerned that the loss of teaching time adversely affected their result.

"Practically, the reimbursement of students perhaps ought to be in teaching hours rather than financially to ensure there is no potential adverse effect on students' grades. Universities will also be conscious that the National Student Survey is currently live for completion by eligible students."
