Is this really the best way to proceed? In our experience the answer is no.
When It is reported that the average cost of a wedding in the UK in 2014 is likely to be in the region of £17,000 why does paying as little as possible for a divorce, which could affect your entire future, make sense?
There are many factors that need to be considered alongside divorce. For example, what happens to the children, how assets of the marriage should be divided and whether there is any need for a financial order. These are not covered with a “quickie” divorce.
A Solicitor’s job is to make sure that you are properly advised from the start. There are many aspects of your life that obtaining a divorce can affect and without proper representation and understanding you may obtain a divorce and without knowing it damage or end them. For example, certain financial claims can be lost once the Decree Absolute is pronounced and if these claims transpire to be necessary for your survival, there is nothing that can be done to resurrect them. In the worst case scenario you could fall into the re-marriage trap, which could end your financial claims relating to the marriage. This could lead to many problems and potentially you receiving a settlement far smaller than you might have been entitled too had you not remarried. All of this is advice that a solicitor can provide and guidance that can be given from the start. Divorce is not just an exercise of filling in a form as some quickie divorces promise.
Quickie divorces also do not provide practical help if something goes wrong. There is no one to provide advice and guidance for example, if the Respondent doesn’t co-operate, there is a mistake on the forms or the Judge reading the divorce papers decides a short hearing is necessary. Some online companies commence divorce proceedings in the court that has the shortest waiting time. This is not necessarily the court closest to you. If the Judge requires a hearing, you may find yourself having to travel to the other side of the country. All of these problems are ones that a solicitor can help you avoid or manage. You may quickly find that the 'quickie divorce' fee is outweighed by the cost you incur by putting things right, attending court, obtaining help serving a Respondent who wont co-operate.
