Mental Health

Alison is Head of the Mental Health team here at Cartwright King. Qualifying as a solicitor in 1998, she has also been an accredited member of the Law Society’s Mental Health Accreditation scheme since June 2004. She has experience of representing patients subject to all civil and criminal sections of the Mental Health Act and is an experienced Advocate before the First Tier Tribunal (Mental Health).

I’ve been dedicated to Legal Aid work since I embarked on my career in law in the 1990s, and becoming a qualified solicitor in 1998. I have experience of representing patients subject to all civil and criminal sections of the Mental Health Act and I am an experienced Advocate before the First Tier Tribunal (Mental Health). I have a particular specialism in dealing with restricted cases and have extensive experience representing patients detained in high secure care at Rampton Hospital. I have been involved in several Judicial Review applications and have a number of reported cases. I have also dealt with appeals including to the Upper Tribunal.

I joined CK in September 2004 on the basis that they were a modern, forward thinking firm, and committed to legal aid work. I established the Mental Health department’s work in the Nottingham area and have enjoyed seeing the department grow and become an established and respected team locally and now nationally. I am proud to work with and manage a very dedicated and experienced group of Mental Health Lawyers

I believe that I represent patients in a sensitive way and I provide honest and clear advice.  I use my knowledge of the law and experience of the system to help clients to achieve their goals.

When not working, I enjoy listening to music/watching live music, watching live sport, walking , reading and spending time with my family.

Notable Cases

Alison has had a number of cases reported during her career as instructing solicitor, all publicly funded Judicial Review cases namely;

  • R V Secretary of State for the  Home Department, Ex Parte Probyn, 1 All ER 357 (1998),
  • R (Hussain) v Derby Magistrates and Another (2001 All ER (D) 26 (Jul),
  • R v Governor of Dartmoor Prison Ex Parte N(2001) EWHC Admin 93,
  • DC V Nottinghamshire Healthcare NHS Trust (2012) UKUT 92 (Acc).

In 2019 she successfully appealed a decision of the First Tier Tribunal (Mental Health) on the basis of an error of law. The original decision was set aside, a fresh panel reconvened and my client was conditionally discharged from detention under the Act as a result of the reconvened hearing

Also in 2019 she secured a deferred discharge against all of the professional evidence in the case, for a client who had been recalled to hospital from a CTO enabling him to return to reside in the community without a CTO.
