What sentence could I face for credit card fraud?

Sentencing for credit card fraud is determined by the Fraud Act 2006. If you are charged with credit card fraud with others, you can be prosecuted and sentenced under common law for Conspiracy to Defraud.

The maximum sentence for fraud is 10 years’ imprisonment. Any sentence will depend on two key factors:

  1. The harm caused by the offence – for example, the financial losses suffered by the victim.
  2. Your part in the alleged crime – if you played a leading role in the crime, you will likely be given a lengthier sentence compared to the sentence handed down if you played a peripheral role.

What are my legal rights if I’m arrested?

  • You have a right to know what offence(s) you have been arrested for
  • You have the right to know the case against you in broad terms
  • You have the right to legal representation
  • You have the right to refuse to answer questions from the police

What are the likely outcomes of my arrest?

There are three likely outcomes following your arrest on suspicion of credit card fraud:
