Frequently asked questions.

What are the most common types of fraud offences?

Fraud is a very broad and complex area of law. It covers a variety of charges but the most common types of fraud thar our solicitors in Middlesbrough come across are:

  • Insurance Fraud – When the insurance process has been used to defraud someone in any type of insurance (home, life, pet, car, medical or other)
  • Credit Card Fraud – Stealing credit cards, selling stolen credit cards, using a stolen credit card, as well as cloning/skimming credit cards are all types of credit card fraud
  • Investment Fraud – This covers corporate fraud cases where investment schemes such as Ponzi schemes, pyramid schemes or boiler room fraud have been used to defraud an investor
  • Bribery and Corruption – Any participation in bribery, whether you are the giving or the receiving party, is a serious criminal offence
  • Cartel and Fixed Pricing – This type of fraud includes anti-competitive practices, such as  bid-rigging, price-fixing rings and limiting your competitors’ access to supply
  • HMRC Tax Investigations – If you are suspected of illegal tax activities, the HMRC has the right to investigate you and your business to establish whether any criminal offence has taken place

What is the penalty if you are found guilty of fraud?

Fraud is considered to be a serious criminal offence and it can be subject to a maximum prison sentence of 10 years and unlimited fines. The severity of the penalty given will depend on the crime committed and the impact it has had on the victims.

Are there any mitigating circumstances in a fraud case?

Yes, certain mitigating factors can be taken into account when deciding on the sentence in a fraud case. The questions that will be asked as part of this include:

  • Did you plan the fraud (premeditated offence) or was this a crime of opportunity?
  • What was the extent of the financial and emotional damages experienced by the victims?
  • What was the duration of your participation in the fraud?
  • Have you made attempts to conceal or destroy evidence that can be used against you?
  • Have the funds gained in the process of the fraud been used to support further criminal activities, such as drug trafficking or human trafficking?

Do I need to hire a specialist fraud solicitor?

Taking the right legal action quickly can have a huge impact on the outcome of your case and the extent of the damages you suffer as a result of fraud or tax allegations. In addition to that, with prison time and large fines potentially on the table, it’s always best to seek advice from an experienced criminal fraud defence solicitor in Middlesbrough to maximise your chances of success.
