Frequently asked questions.
What to expect if you have been accused of a criminal offence?
If you have been accused of a criminal offence and your case goes to trial, the following will happen:
- The crime is reported and investigated by the police
- The Crown Prosecution Service (CPS) decides whether the case should be tried based on the evidence
- The judge reviews your case and all evidence provided
- If required, a jury is selected under the supervision of the judge
- The prosecution and the defence present their case
- The jury give their verdict
- If the defendant is found guilty, the judge decides the sentence
Our criminal law solicitors in London will build a criminal defence strategy and will represent you at all stages – police station right through to court. You can get in touch with the Cartwright King team 24 hours a day and at any stage of your criminal case. The earlier you get in touch with one of our experts, the faster we can start working on achieving the best possible result for your situation.
What court will my case be tried in?
If the Crown Prosecution Service (CPS) decides there is enough evidence to prosecute then your case is likely to go to trial. If the offence is minor it is likely your case will be tried by a district judge at the Magistrates Court. However, if the offence you have been charged with is serious, then it will be tried in the Crown Court and the verdict will be decided by a jury and a judge.
How can you prove guilt in a criminal case?
The prosecution has the task of proving the guilt of the defendant beyond a reasonable doubt. It is our role as the defence to ensure that the judge or jury have enough reasonable doubt that they cannot be sure of the defendant’s guilt.
Our criminal law solicitors will employ various defence strategies to create reasonable doubt and present your involvement in the case in the most favourable light to achieve the best possible outcome for you.
Can I appeal a guilty verdict?
Yes, if you have been given a guilty verdict in Court, we can help you appeal both your conviction and your sentence. Our criminal lawyers can apply to obtain permission to appeal and if granted, we can take your case to the Court of Appeal.
