In terms of defending your case and sentencing, it is the dishonest intent associated with this offence that needs to be overcome. However, dishonest intent can be difficult to prove beyond doubt as it means being absolutely sure what was in somebody else’s mind. 

For this reason, it must be shown that the actions would be deemed, by the average person, to be dishonest and that the offender would have acknowledged it as such. 

If this is the case and you are found guilty, you could potentially face a heavy fine and a prison sentence of 3 – 7 years, subject to circumstances.
