Immigration Help with Deportation and Removals from the UK

Our team understands that experiencing deportation and removal from the UK is very distressing. That’s why we want to help you exercise your rights and get the end result you need, with minimal stress and our full support.

We are here to help you whilst you are in detention and facing removal from the UK. We can offer you legal advice tailored to your situation, making sure that you and your family do not suffer and getting you the best outcome possible.

Immigration Detention

The UK government holds the power to detain any person who does not hold leave to remain, or whose leave has expired. This also applies if you have been convicted of a criminal offence and you are held under immigration powers following the completion of your criminal sentence. This will often mean you will remain in custody in prison as a civil prisoner. There is no time limit on how long you can be held on immigration powers.

Our team knows that being detained is often very traumatic. It can have an impact on the person who is in detention, as well as their close family and friends.

This is why we will do our best to help you if you have been detained so that you have the best chance of being able to live your life in peace.

If You Are In Immigration Detention?

We believe that it is important that you are aware of your legal rights whilst you are being detained. Knowing and exercising your rights can empower you whilst you are still subject to detention, and also help you take a step closer to resuming your freedom.

When in detention, you have the right to access legal advice. We can advise you whilst you are in detention, if you are being threatened with detention and when you are facing deportation. We will fight in your corner to get you released so that you can get back on with your life.

We can provide you with expert legal knowledge and offer you and those close to you the support you need. We understand that undergoing immigration detention is an unpleasant experience, which is why we want to help you get released so you are able to move forward with your life.

Immigration Removal

What is Immigration Removal?

If you do not have valid leave to remain in the UK or you are a failed asylum seeker, the Home Office can use immigration powers to begin removal. The Home Office will tell you in writing if you are required to leave the UK and they will offer assistance if you wish to leave voluntarily. In their letter they will tell you how to provide further evidence if you have other reasons for why you should be allowed to remain in the UK.

You will usually only be removed if you have exhausted all avenues to try to prove that you should be allowed to stay in the UK. This includes any appeals and judicial reviews you are entitled to.

If the Home Office are successful in the removal process , you will face travel restrictions in the form of a re-entry ban into the UK. This means that you are not allowed back into the country for a period specified at the time of your removal. The length of the ban will depend on whether you left voluntarily or at the expense of the Home Office. The re-entry ban can be for a 2-year, 5 year or 10 year period.

What is Deportation?

A person could go through the deportation process if they have committed a crime in the UK and received a custodial sentence of 12 months or more. In addition, the Home Office could direct that a person should be deported if it is conducive to the public good. There are different rules for the deportation of EEA nationals and their family members and the deportation of those who are a foreign national.

If a person is facing deportation, the Home Office will provide you with written reasons for their decision. This is often referred to as a section 120 or one-stop notice. It is very important that you seek immigration advice as soon as possible as there is usually a deadline for when a response is required. If you have any reasons for why you should not be deported, this will be your opportunity to make your case. Our team can help you make your case to the Home Office. If the Home Office accept your reason, deportation action will be stopped. However, if they do not accept your reasons, you may have the right of appeal. This will mean that your case will be heard by an independent Judge at the First-Tier Tribunal. Deportation appeals are complex in nature and we would recommend that you contact us to discuss your options.
