What does a GCC investigation involve?
If you’re investigated by the GCC, you will first receive a copy of the complaint(s) made against you. You have 28 days to respond to the complaint(s) made against you. Following your response, a GCC Investigation Committee will meet to determine if there’s any merit for opening an investigation against you.
If the GCC decides that there is grounds for an investigation, your case will be referred to either a Health Committee or a Professional Conduct Committee.
If a complaint is made against you concerning criminal activity, you could be subject to a criminal investigation. Cartwright King can advise and assist you in dealing with GCC matters and criminal cases against you.
What happens if a GCC investigation finds me guilty of misconduct?
If a GCC investigation finds you guilty of misconduct, the nature and severity of the misconduct will have a bearing on what happens next. Professionally, you could be struck off, suspended or heavily fined. If you’re found guilty of a criminal charge, you could face a prison sentence.
Can I still work while under investigation?
In some circumstances, you can still work while under investigation by the GCC. However, at any stage of the investigation, the GCC can decide to refer you for an interim suspension hearing held by the Investigating Committee.
The Committee will consider whether a complaint made against you warrants a suspension if there’s immediate concern for the protection of the public. If you’re referred for an interim suspension hearing, you will be given 10 days’ notice of the hearing and whether you have the right to attend with legal representation.
