What does a Nursing & Midwifery Council investigation involve?

An NMC investigation is typically the longest part of the process and has been known to take years. When under investigation, an NMC investigator will gather evidence in relation to concerns over your fitness to practice. The evidence collected can include medical records, CCTV footage and more.

The investigator will also speak to you directly to hear your version of events. You can seek legal advice prior to speaking to an NMC investigator so that your rights and your best interests are protected. 

The investigator will also speak to any witnesses as part of their investigation.

As the investigation progresses, you will be contacted every four months for an update. Once the investigation is complete, you will be notified and the investigator will write a report and a dossier of evidence will be compiled. A decision will then be made by the NMC on whether a hearing is needed.

You will be presented with a copy of the report and the NMC’s findings to which you can respond within 28 days.

What happens at an Nursing & Midwifery Council hearing?

An NMC hearing is a formal process where three panel members, who are independent of the NMC, will make a decision on your case. At least one of the panel members will be a nurse or midwife.

The case against you will be presented by a case presenter on behalf of the NMC who will call any witnesses for the case. You will also be able to present your evidence.

You can have someone with you in your hearing while you’re giving your evidence, but they are not permitted to participate in the hearing.

Following a hearing, a decision will then be made on what action will be taken against you. This can include:

  • An interim orders hearing
