Frequently asked questions.
What is the Teaching Regulation Authority (TRA)?
The Teaching Regulation Authority (TRA) is the industry body that assumed the responsibility of regulating and disciplining teachers, taking over from the National College for Teaching and Leadership (NCTL) in April 2018.
The TRA’s role is to support employers, schools and headteachers with safeguarding duties by responding to allegations of serious misconduct by teachers. The TRA’s Professional Conduct Panel is responsible for hearing allegations and making recommendations on any action that should be taken against teachers.
What powers does the TRA's Professional Conduct Panel have?
The TRA’s Professional Conduct Panel has the power to make teachers the subject of a Prohibition Order. A Prohibition Order effectively bans you from teaching for life. However, in some cases, such an order will include a provision for it to be reviewed after a specific period of time.
Can I appeal the decision of the TRA's Professional Conduct Panel?
Yes, but only if you have grounds to do so under law. An appeal has to be lodged with the High Court specifying detailed grounds for your appeal. You must file an appeal within 28 days of being notified of the outcome of your case.
Cartwright King can advise you on the merits of appealing, ensure that your appeal is lodged within the 28 day deadline and make sure that it’s properly presented to give it the best chance of success.
Once your appeal has been lodged, both you and the TRA will be contacted by the High Court to set a timetable for any directions that must be adhered to and to allow for the exchange of any further documentation.
A hearing date will be set, at which a High Court judge will hear all the evidence and decide whether your appeal should be allowed.
