What does an Solicitors Regulation Authority investigation involve?

The SRA will investigate you if they receive a complaint or report about you potentially breaching its Standards and Regulations. If a complaint has been made, you will be contacted by the SRA if they decide to investigate you.

If the SRA deems that an investigation is necessary following a complaint, they will start to gather evidence. This can include documentary evidence, witness statements and more.

The SRA will also contact you for your version of events and you may be asked to comment on any evidence that has been gathered against you. In some cases, the SRA may conduct an on-site investigation at your firm.

How long does an SRA investigation take?

It’s difficult to determine how long an SRA investigation may take. The SRA does say that it aims to complete 93% of its investigations within 12 months. This indicates that an investigation can take anything up to a year.

The SRA may be able to gather evidence quickly and reach a decision. In other cases, the evidence may take longer to gather and review. However, you will be kept up to date on how your case progresses.

What are the possible outcomes of an SRA investigation?

Most SRA cases are closed without any regulatory action. However, if the SRA decides that action does need to be taken, your case could be referred to the Solicitors Disciplinary Tribunal, which has the power to:

  • Stop you from working in a law firm without approval from the Law Society
  • Suspend you from legal practice 
  • Strike you off
